If you have missed your
Probation appointment, call your assigned Probation Officer and reschedule.
Please do not come to the office without a scheduled appointment, unless it is
an emergency.
The Gallipolis Municipal Court has a Community Control
Department which oversees all persons placed on community control as the result
of criminal charges. The goal of community control is to monitor compliance with
the sentence imposed by the Judge thereby reducing the likelihood of further
criminal activity. The Gallipolis Municipal Court Community Control Department
is run under the direction of Chief Probation Officer Michael Smith.
Each probationer will be assigned to a probation officer who will supervise the
terms of their probation, and provide assistance to the probationer in complying
with those terms. The community control department has established standard
rules for probation in addition to any requirements imposed by the sentencing
Judge. The standard rules for community control are provided for your
convenience, but you are urged to remember that these are minimum requirements,
and additional conditions may be imposed by the Judge.
GENERAL RULES OF COMMUNITY CONTROL
STANDARD TERMS
- You
shall refrain from violation of any law (Federal, State and local). Any
infraction may result in a community control violation wherein original jail
time may be imposed. You shall contact your community control officer within
2 days if arrested or questioned by law enforcement.
- You
must keep your community control officer informed of your address at all
times. Failure to notify your community control officer within 7 days of
moving may result in a community control violation.
- You
shall work regularly at a lawful occupation and support your legal
dependents, if any, to the best of your ability. When out of work or
changing employers, you shall notify your community control officer within 7
days.
- You
shall treat all community control and court personnel with respect. You
shall follow all community control personnel instructions.
- You
shall not be under the influence of or consume or possess alcohol, drugs or
any substance of abuse, or be found in any establishment where alcohol is
sold and consumed.
- You
shall not possess, use, sell, distribute, or have under your control any
narcotic drugs, barbiturates, marijuana, or any scheduled substance as
defined in the Ohio Revised Code or instruments for administering them
except on prescription of licensed physician, and taken in accordance with
said prescription.
- You
shall submit to a search of your person, vehicle or place of residence by
any community control officer or law enforcement officer with or without
probable cause while on community control.
- On
demand of the community control officer or law enforcement officer, you
shall submit a sample of blood, breath or urine at any time. Refusal to
submit or the presence of a controlled substance or alcohol shall be
considered a violation.
- You
shall successfully complete and provide proof of completion of any
program to which you are ordered.
- You
shall make monthly payments toward your fines, court cost and restitution as
ordered by the court. Failure to make monthly payments on fines, court costs
and restitution may result in a community control violation.
- You
shall report in person to the community control officer where and when
instructed.
Probation
Fees
In 2004 the Community Control Department implemented a program whereby each
defendant placed on Community Control pays a $50.00 probation fee per case as a
condition to community control. The funds generated from probation fees are
appropriated to maintain current in house programs, as well as to develop and
implement other treatment oriented programs.
Urinalysis Drug Testing Program
The Urinalysis Drug Testing Program is an essential tool for identifying
offenders abusing illicit drugs. This testing is conducted on-site and provides
immediate results to assist probation officers in determining the most effective
treatment and sanctions. Offenders
testing positive for any illicit drugs will be assessed a $35.00 drug testing
fee.
